1. The personal data relating to you as a person seeking employment will be processed for the purpose of the recruitment process for the position specified in the job advertisement to which you have responded.

2. Within the scope specified in section 1, the personal data provided will be processed pursuant to Article 221, § 1 and 2, of the Labour Code in conjunction with Article 6, section 1, letter c, of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), hereinafter referred to as ”GDPR”. If you give your voluntary consent, your personal data will also be processed:

  • in relation to your image or photograph in your CV (legal basis: Article 221a, § 1  and 3, of the Labour Code in conjunction with Article 6, section 1, letter a, of GDPR),
  • in relation to personal data other than the data referred to in Article 221a, § 1 of the Labour Code, except for the personal data identified in Articles 9 and 10 of GDPR  (legal basis: Article 221a, §   and 3, of the Labour Code in conjunction with Article 6, section 1, letter a, of GDPR),
  • in relation to special categories of personal data, e.g. biometric data (legal basis: Article 221b, § 1 of the Labour Code and Article 9, section 2, letter a, of GDPR),
  • for the purposes of future recruitment processes (legal basis: Article 6, section 1, letter a, of GDPR). Moreover, pursuant to Article 6, section 1, letter f, of GDPR, the bases for processing include the controller's legitimate interest consisting in the countering and prevention of fraud as well as the exercise or defence of legal claims.

 

 

 

3. In respect of the legal basis provided for under Article 6, section 1, letter a, and Article 9, section 2, letter a, of GDPR, you have the right to withdraw your consent at any time, without affecting the lawfulness of processing based on consent before withdrawal.

4. The Controller will be transferring your personal data to other recipients who have been engaged to process personal data for and on behalf of the Controller. Moreover, the Controller will make your personal data available to other recipients where such disclosure is required under applicable laws; your personal data will not be transferred to third countries or international organisations.

5. Your personal data will be kept for the period of time necessary to complete the recruitment process (process of seeking employment) for a specific position – for a maximum of 60 days. If you have given your consent to your data being used for the purposes of future recruitment processes, your personal data will be kept and processed for a period not exceeding 6 months. If you withdraw your consent to future recruitment processes or future use of your image, such data will be removed immediately. In the case of your data being processed for the Controller's legitimate purpose your personal data will be kept until the time you lodge your objection or the claim becomes time-barred.

6. The provision of the personal data referred to in Article 221 § 1 items 1 – 3, and the personal data specified in items 4-6 of the Labour Code, if necessary for the purpose of performing work in a given position - is voluntary, but necessary for a candidate to be included in the recruitment process . Failure to give consent to the use of your image will not affect the recruitment process for the position you are currently applying for. The provision of the personal data referred to in Article 221a, § 1 and 3, of the Labour Code (consent for the processing of data other than the data specified in Article 221a § 1 of the Labour Code) may not be used as a basis for your being treated unfavourably in the employee selection process or serve as a basis for refusal of employment (Article 221a § 2 of the Labour Code). Failure to give consent to the use of your personal data for the purpose of future recruitments will not affect the recruitment process for the position you are currently applying for.

7. You have the right to request that the Controller provides you with access to your personal data and the right to have your data rectified, deleted, to restrict the processing thereof, right to data portability, right to object (in the case of processing pursuant to Article 6, section 1, letter f, of GDPR), as well as the right to withdraw your consent (in the case of processing pursuant to Article 6, section 1, letter a or 9, section 2, letter a, of GDPR) and the right to withdraw your consent at any time, without affecting the lawfulness of processing based on consent before withdrawal. You have got the right to lodge a complaint with a supervisory authority i.e. President of the Office for Personal Data Protection if you feel that the processing of your data infringes the provisions of GDPR.

8. Your personal data will not be transferred outside the EEA or to an international organisation.

9. Your personal data will not be processed in an automated manner, including profiling, i.e. no decisions which have a legal or similarly significant effect on a person will be based solely on automated processing of personal data or will be related to such an automatic decision.
